According to WFTV Channel 9 in Orlando Joseph Habib the Firefighter accused of molesting four boys in a pool in Orlando was freed again after the judge in the case rules that the state waited too long to press the new charges. Habib was on trial in June for the molestation of three boys and despite testimony from the three young boys in court the jury gave him a lesser charge of lewd and lascivious instead of felony molestation charges. Than a few days later Habib was arrested again when a fourth boy who was at first reluctant to testify agreed to come forward.

The judge however ruled that the state waited too long to bring the forth child forward and that Habib’s right to a speedy trial was violated. The ruling is currently being appealed by the state attorney and no answer has been given yet.

I have been asked to completely absolve Habib of any wrongdoing by a person close to the case, but he was still convicted of lewd and lascivious and the new charges are in the appellate courts hands. If the jury would have found him innocent of the first three charges I would have no problem with complying, but they didn’t so I am still going to be following this case.
